Terms of Service

1. Using the service

You may use the service only if you can form a legally binding contract where you live and you are at least 13 years old, or the minimum age required in your country. You agree to provide accurate information and to keep your account secure. You are responsible for everything that happens through your account.

2. Your content and the license you give us

You keep ownership of everything you post, including photos, collection details, listings, messages, and profile information. To let us run the service, you grant us a worldwide, non-exclusive, royalty-free licence to host, store, reproduce, display, and distribute your content as needed to operate the service. This licence lasts for as long as your content is on the service and ends when you delete it, except for content you have shared publicly with others that we must keep temporarily for technical reasons.

When you post content you confirm and warrant that you own it or otherwise have the right to share it, and that it does not break these terms or anyone else's rights, including copyright, trademark, privacy, and publicity rights.

3. Rules for content and conduct

You agree not to do any of the following:

• post content that is unlawful, harmful, threatening, abusive, harassing, hateful, or that promotes violence;
• upload content you do not own or do not have permission to share;
• share someone else's private information without consent;
• infringe copyright, trademark, or other intellectual property rights;
• post false, misleading, or fraudulent information, including fake listings or fake prices;
• attempt to disrupt, overload, or gain unauthorised access to the service, its systems, or another user's account;
• use the service for any illegal or unauthorised purpose.

We may review and remove content, or limit or close an account, when these rules are broken or when we believe content poses a risk to the service or its users. We are not obliged to monitor all content, but we will act on valid reports.

4. Reporting content and intellectual property (DMCA)

We respect intellectual property rights. If you believe content on the service infringes your copyright or other rights, send us a notice that includes:

• your contact details;
• a clear description of the content you believe is infringing and where it is located;
• proof that you own the rights, or are authorised to act for the owner;
• a statement made in good faith, and your physical or electronic signature.

Send notices to info@allhotwheels.com. We will review valid notices and remove or disable access to the content in question. We may also suspend accounts that repeatedly infringe the rights of others. If you believe your content was removed by mistake, you may send a counter-notice and we will consider restoring it.

5. Affiliate links

Some links to eBay and Amazon are affiliate links. If you buy through them we may earn a commission at no extra cost to you. Prices and availability are set by those platforms and can change at any time. We are not the seller for items bought through these links.

6. Marketplace and trading between users

The service lets collectors list cars for sale and contact one another. Any transaction is strictly between the buyer and the seller. We are not a party to your agreement and we do not take possession of, pay for, or guarantee any item.

We do not guarantee that a listing is accurate, that a seller is trustworthy, or that a transaction will be completed. You use the marketplace at your own risk and are responsible for taking reasonable care before sending money or goods. Where required by law, consumer rights you cannot waive continue to apply.

7. Content from other members

Content posted by members reflects their views, not ours. We are not responsible for what members post, including prices, photos, descriptions, or statements. If you rely on content from another member, you do so at your own risk.

8. No warranty

The service is provided to you as is and as available, without warranties of any kind. To the extent allowed by law, we do not promise that the service will be uninterrupted, error-free, secure, or that prices, values, or statistics shown are accurate. Any value or price estimate is provided for general information only and is not professional advice or an appraisal.

9. Limitation of liability

To the maximum extent allowed by law, neither we nor our providers shall be liable for any indirect, incidental, special, or consequential damages, or for loss of profits, data, or goodwill, arising out of or related to the service. Our total liability for any claim is limited to the amount you have paid us, if any, to use the service in the past twelve months. Nothing in these terms limits liability for things that cannot be excluded under applicable law, such as liability for gross negligence or wilful misconduct in some jurisdictions.

10. Indemnity

You agree to defend and hold us harmless from any claims, damages, and expenses arising from your content, your conduct, or your breach of these terms, to the extent allowed by law.

11. Closing an account

You may close your account at any time. We may suspend or close your account, or stop providing the service, if you break these terms, if your activity creates risk or legal exposure for us, or for any other reason with notice where appropriate. When your account closes, your licence to us for your content ends and we remove your data as described in our Privacy Policy.

12. Governing law and disputes

These terms are governed by the laws of the jurisdiction in which the operator of the service is established, without regard to conflict of law rules. Before taking formal action, we ask both sides to try to resolve any dispute informally first by contacting us. Nothing in these terms affects the statutory rights you have as a consumer under the mandatory laws of your country of residence.

13. Changes to these terms

We may change these terms as the service evolves. If we make material changes we will let you know through the service or by email before they take effect. Continuing to use the service after a change means you accept the updated terms.
